Terms of Service

The terms on which consumers and business users may use Wmarks.

1. Provider and scope

A consumer is a natural person acting predominantly outside their trade or profession. A business user acts in the course of that activity when entering into the contract.

Lemon Squeezy / Sold through Link, LLC acts as merchant of record and authorised reseller for the payment and sale transaction. It collects payment, calculates applicable indirect taxes and provides receipts. Wmarks supplies and remains responsible for the SaaS service, accounts, credits, results and product support. Mandatory rights are unaffected by this allocation.

The purchase and payment transaction is handled by Lemon Squeezy / Sold through Link, LLC as merchant of record and authorised reseller. Jakob Klingels, sole proprietorship, is the supplier and provider of the Wmarks SaaS service and is responsible in particular for provision and use of the service, the user account, redemption of credits and product support. The Lemon Squeezy terms additionally apply to the purchase transaction; these Wmarks Terms apply to the use of Wmarks.

2. The service and its evidence classes

VERIFIED
The specifically identified technical finding was directly or cryptographically checked by the displayed method. It proves only what that individual finding expressly states.
DECLARED
A source, tool, metadata field or markup states an origin or edit. Wmarks confirms the presence of the statement, not its truth.
FORENSIC INDICATION
A named technical analysis produced an indication. An indication is not proof.
NOT VERIFIABLE
The signal type currently cannot be checked publicly, technically, or because a provider is unavailable. The answer is unknown, not negative.
  • A C2PA or Content Credentials carrier is not automatically proof of AI generation. A manifest may be present but not cryptographically validated.
  • Hidden characters, Unicode anomalies, container data and generator metadata may be technical findings or declarations, but alone they do not prove AI authorship.
  • “No supported or verifiable origin signal found” does not mean human-created, AI-free or original.
  • Wmarks does not guarantee detection of all AI-generated content, edits or watermarks. Vendor signals that cannot be publicly verified are reported as not verifiable.
  • Wmarks does not remove watermarks, offer a humaniser, or rewrite content to evade provenance or detection systems.

3. Supported content and limits

The credits required are shown before a chargeable check and settled against the scope actually inspected. No check runs on an insufficient balance. A check that produces no result — because of a format error, a blocked address or an internal failure — is not charged.

4. Contract formation

Public free use begins when a check is submitted. A free account agreement is formed when registration is accepted. Product pages are an invitation to order.

Immediately before a paid order, the product, the credits included, the total price including VAT and — for Pro — the billing interval, automatic renewal and cancellation options are clearly displayed. A paid order is placed only via a button that unambiguously states the obligation to pay.

After successful payment you receive a confirmation on a durable medium by email. It contains the product, price, the parties involved, the applicable terms and withdrawal versions, any declaration you made about early performance, and the receipt link.

5. Credits

Credits are prepaid or granted units of use for Wmarks services. They are not money, e-money or a financial instrument, bear no interest and are not freely transferable. They cannot be redeemed for cash; mandatory withdrawal, refund, conformity and damages rights remain unaffected.

Purchased credits
from one-time credit packs. They do not expire while the account exists.
Subscription credits
from successfully billed Pro periods. Unused subscription credits roll over and remain usable in the Free account after an ordinary cancellation.
Promotional credits
including signup and goodwill grants. They expire only if a concrete date was clearly shown when granted; without such a disclosure they do not expire.

Consumption order: earliest-expiring promotional credits first, then non-expiring promotional credits, then the oldest subscription credits, and finally the oldest purchased credits. Within a class, oldest first. The account shows the total balance and the source of the remaining credits.

Credits are granted only after a verified payment webhook. On a refund, only the credits still remaining from that specific purchase are reclaimed. Services already used do not create a negative balance or an automatic debt; any statutory compensation is calculated solely under the withdrawal notice.

Pro begins when the first payment is confirmed and renews automatically for one month at a time until cancelled. Ordinary cancellation is possible at any time effective at the end of the current billing period; the confirmed end date is displayed and confirmed electronically. There is no minimum term beyond the current month.

When the subscription ends the account returns to Free. Existing purchased and subscription credits remain usable. A failed renewal payment grants no new monthly credits; existing credits and statutory rights are unaffected.

7. Withdrawal, cancellation and refunds

Consumers generally have a fourteen-day right of withdrawal from contract formation under the separate withdrawal notice. Access to the software and the checks are digital services; beginning to use them does not by itself end the right of withdrawal.

Consumers may declare a withdrawal at any time through our public electronic withdrawal function and cancel a Pro subscription through the continuously available public cancellation process under § 312k BGB. Neither requires signing in. The equivalent functions are also available in the account.

Statutory conformity rights for digital products remain. Refunds are handled operationally with Lemon Squeezy; its merchant-of-record role does not remove claims against the party actually responsible.

8. Acceptable use

The following are prohibited in particular:

  • submitting content you are not authorised to have processed, and infringing rights or confidentiality
  • malware, automated overload, and circumventing quotas, credits or security measures
  • accessing third-party or private systems, and submitting tokenised URLs without authority
  • removing or evading watermarks and provenance signals
  • using a result as the sole basis for grading, examination, employment, credit, insurance, law enforcement or similarly significant decisions about a person

A material or repeated breach may lead, after a proportionate warning where possible, to restriction or termination for cause.

9. Conformity and liability

Statutory rights for digital products apply. It is not a defect that an actually absent, unsupported or non-publicly-verifiable signal is not detected, where the service description and result status accurately disclose that limit. Concrete promises about formats, active verifiers and methods remain binding.

Wmarks is liable without limitation for intent, gross negligence, culpable injury to life, body or health, under product liability law, for fraudulent concealment and within the scope of express guarantees. For slight negligence affecting an essential contractual obligation, liability is limited to the foreseeable loss typical of the contract. Otherwise liability for slight negligence is excluded. Mandatory consumer rights are unaffected.

10. Law, venue and language

German law applies, excluding the CISG, without depriving consumers of mandatory protections in their country of habitual residence. The contract language is German; the English version is provided for English-language use, and mandatory law remains unaffected.
